The Milli Majlis of Azerbaijan is set to discuss the tightening of safety control in the aviation sector during its next plenary session, which includes the introduction of new fines.
The Committee on Legal Policy and State Building discussed the corresponding amendments to the Code of Administrative Offenses today, and the bill was recommended for the parliament's plenary session.
According to the document, the fine for removing any element of an aircraft, cargo, or baggage found at the site of an aviation accident or incident without permission is proposed to be increased from 500 to 600 manats. A new article to be introduced in the Code provides for fines of 1,000 manats for individuals, 5,000 manats for officials, and 10,000 manats for legal entities for interfering with the activities of the permanent commission investigating aviation accidents and incidents.
New fines are also being established for violations of requirements for aviation personnel. Employing persons in civil aviation who do not have the necessary certificate, ID, or certification (issued in a foreign country and recognized in the prescribed manner) will result in fines of 3,000 manats for individuals, 5,000 manats for officials, and 20,000 manats for legal entities.
Failure to ensure that flight and cabin crews, as well as dispatchers, undergo appropriate training, practice, and medical examination will result in fines of 4,000 manats for individuals, 8,000 manats for officials, and 30,000 manats for legal entities.
In addition, fines are being introduced for violating the general requirements for the operation of civil unmanned aerial vehicles (UAVs):
- Operating a UAV club or association without proper permission: 3,000 manats for individuals, 5,000 manats for officials, and 8,000 manats for legal entities;
- Flying civil UAVs in controlled airspace and aerodrome territory without the permission of the authorized center: 3,000, 7,000, and 15,000 manats, respectively;
- Failure by the operator to comply with the center's instruction to immediately stop the flight or change the operation: 4,000, 7,000, and 17,000 manats, respectively.
Moreover, operators using an aircraft without insuring their liability for damage (except for the provided case) will be fined 5,000 manats for individuals, 10,000 manats for officials, and 50,000 manats for legal entities. In the case of UAVs, the fines will be 3,000, 5,000, and 10,000 manats, respectively.
New fines are also provided for non-compliance with certification requirements in the field of civil aviation. If the determination of the professional suitability of aviation personnel is entrusted to uncertified medical institutions and their employees, officials will face a fine ranging from 5,000 to 8,000 manats, and legal entities will face fines ranging from 20,000 to 30,000 manats.
Furthermore, the operation of civil airports or airfields, as well as helicopter pads, without certification will result in fines of 3,000-4,000 manats for individuals, 7,000-9,000 manats for officials, and 20,000-40,000 manats for legal entities.
In the absence of the necessary certification for air navigation service providers and organizations involved in the design, production, or maintenance of systems and their components, officials will be fined 7,000 to 9,000 manats, and legal entities will be fined 20,000 to 40,000 manats.
The absence of certification for organizations providing maintenance or managing the airworthiness of civil aircraft and their components will result in fines ranging from 7,000 to 9,000 manats for officials and 20,000 to 40,000 manats for legal entities.
The use of uncertified aviation equipment and facilities, with or without confiscation of the equipment and facilities, will result in fines of 2,000 manats for individuals, 5,000 manats for officials, and 50,000 manats for legal entities.
Other amendments to the Code of Administrative Offenses relate to cases that have caused minor harm to human health through negligence. In particular, if the incident occurred due to a violation of the rules of traffic safety and the operation of aircraft by an employee obliged to comply with these rules, it is proposed to introduce a fine ranging from 500 to 1,000 manats. Taking into account the circumstances of the case and the identity of the offender, an administrative arrest for a period of 10 to 20 days is also possible.
