SIA presents the interview of Ahmad Ismayilov, Executive Director of the Media Development Agency (MEDIA) with reference to APA:
- Have you submitted your proposals on the preparation of a draft law establishing administrative liability for violation of the Law on Media? What do those proposals mean?
- After the adoption of the Law "On Media", in accordance with the Decree of President Ilham Aliyev, we submitted the draft amendments to all regulations in the order of harmonization. There were instructions on the rules of maintaining the Media Register in Azerbaijan and the approval of a standard form of journalistic cards. Draft normative legal acts are also being prepared and submitted accordingly. These projects are currently being discussed with relevant government agencies and will be submitted to the government within the agreed timeframe. Issues related to the establishment of administrative liability for violation of the Law "On Media" in the framework of the tasks in the Decree of the President are also under discussion. As a result of the discussions, we will have agreed proposals, if deemed appropriate. At present, there are norms in the normative legal acts related to the media and abuse of journalistic activity. If there is a need to amend these provisions in connection with the application of the law, our proposals will be submitted.
- Has the draft rules for maintaining the Media Register been prepared?
- As I mentioned earlier, the coordination of the rules of the Media Register with the institutions is nearing completion. Once agreed, it will be submitted to the government and the rules will be approved accordingly. Once the rules are approved, the software and other technical requirements for the Registry will be developed and finalized, taking into account the requirements of information technology. It will be presented to the media community as soon as possible.
- Has the form of a journalist's card been determined? What is your suggestion on the amount of payment for the issuance or replacement of a journalist's card?
- According to the Law on Media, a certain fee is provided for this. Because, as you know, all services provided by the state have fees and charges. It is also currently under discussion. There is a need to confirm a fee for the issuance of the card. That is, after approval, we will pass the relevant information to the media.
- Has any amount been considered?
- It will not exceed the cost of developing a certificate for any service and presenting it to journalists. This is not a very expensive service.
- What mechanisms will be used to eliminate the problems in the field of reference?
- The Law on Media clarifies issues related to copyright. Our MEDIA Agency is very attentive to this issue. Recently, we have presented a sample form to the media in order to assist in the development of a professional code of each media entity on the rules of professional ethics. At present, discussions are being held in media outlets based on this model form, and the process of improving them by media outlets themselves and approving these codes of professional ethics within the framework of each media entity's own editorial policy has already begun. These rules will be posted on the websites of media entities and in their information resources. We believe that the application of these codes, guided by each media entity, will in itself give impetus to the protection of copyright. However, this is an issue where everyone should apply for copyright and express their views to other media outlets on the protection of their rights. As a media agency, we take these cases very seriously. When we come across such cases in the monitoring, we give recommendations to the media to eliminate such cases.
The rights of each of our journalists and media subjects are guaranteed by the Law on Media. If any assistance is needed in the protection of these rights and if they apply to the Media Agency, we will provide appropriate assistance within our powers, taking into account the requirements of regulatory legal acts.
