President Ilham Aliyev has signed a decree on registration of rights to apartments and houses built at the expense of the state in connection with the elimination of natural disasters, man-made disasters and military operations in the territory of the Republic of Azerbaijan, as well as regulation of some issues related to their land plots. .
SIA reports that the decree stipulates:
Local executive authorities:
- construction at the expense of the state instead of dwellings destroyed or rendered unusable as a result of a natural disaster, man-made accident or military operation (except for the liberated territories) in the territory of the relevant administrative-territorial units, and construction and installation until the entry into force of this Decree a list of persons to whom completed or new construction of new dwellings and apartments in multi-apartment residential buildings have been provided (specifying the dwelling house and (or) apartment handed over to each person), a copy of the architectural-planning section of the construction project in respect of dwelling houses, operation in the case of permitted apartment buildings, to submit a copy of the architectural-planning section of the construction project of the building and the permit for operation to the State Service for Property Issues under the Ministry of Economy of the Azerbaijan Republic within two months;
- to resolve other issues arising from this Decree.
Ministry of Economy of the Republic of Azerbaijan:
- on the basis of applications of the persons named in the list provided for in part 1 of this Decree, ensure the registration of their property rights on residential areas, as well as backyards of residential houses in the state register of real estate within the period specified by the Law of the Azerbaijan Republic "On State Register of Real Estate";
- when considering the appeals of the persons named in the list provided for in part 1 of this Decree:
- in case the land plots on which residential houses and multi-apartment residential buildings are built are owned by the municipality, submit information on the coordinates and size of the turning points of those land plots to the Cabinet of Ministers of the Azerbaijan Republic within one month from the date of such discovery;
- in cases when residential houses and apartment buildings are built on land not intended for this purpose, to ensure the submission of a petition to the Cabinet of Ministers of the Republic of Azerbaijan to change the category of these land plots;
- inform the President of the Republic of Azerbaijan once every six months on the work done in connection with the implementation of paragraphs 2.1 and 2.2 of this Decree;
- to resolve other issues arising from this Decree.
The Cabinet of Ministers of the Republic of Azerbaijan:
- on the basis of the information provided by the Ministry of Economy of the Republic of Azerbaijan in accordance with paragraph 2.2 of this Decree:
- in case of construction of residential houses and multi-apartment residential buildings on the lands owned by the municipality, to provide allocation of land plots from the state property in proportion to the municipality;
- in cases specified in sub-clause 2.2.2 of this Decree, as well as if necessary, to ensure that the category of land plots allocated to municipal property in accordance with sub-clause 3.1.1 of this Decree is changed and assigned to the category of lands of settlements;
- take measures to formalize the property rights of citizens on the land plots on which residential houses are located and inform the President of the Republic of Azerbaijan about it once every six months;
- for the purpose of allocating land plots for the construction of houses and apartment buildings at the expense of the state instead of housing destroyed or rendered unusable as a result of a natural disaster, man-made accident or military operation, registration of rights to real estate, as well as simplification of urban planning and construction procedures to submit proposals to the President of the Republic of Azerbaijan within two months on the improvement of normative legal acts regulating relations in this field;
- to resolve other issues arising from this Decree.
