Milli Mejlis passes bill on ex-president

Milli Majlis, the parliament of Azerbaijan adopted a Constitutional Law on ensuring security of ex-presidents of the Republic of Azerbaijan and their families.

The law will be implemented in respect of the persons taking the office of the president in the past except the presidents ousted in accordance with Article 107 of the Constitution. Since there are no such cases in Azerbaijan, the law will be implemented in respect of all ex-presidents.

The law gives some privileges to the ex-presidents and their families.

The law consists of 12 articles. According to the Constitution, ex-presidents are the persons taking the office of the President of the Republic of Azerbaijan in the past, the persons, who died during the office or ended the office in accordance with Article 104 of the Constitution. The law also has the articles concerning the ex-president’s spouse and children, adopted or stepchildren under age of 18.

According to the law, amount of the ex-president’s pension is equal to 50 percent of his monthly salary during the presidency. The president impeached in accordance with Article 107 of the Constitution has no right to get this pension.

The document also covers the allowance for the spouse of the deceased president and dependent family member. After the death of former president, allowance in the amount of 50 percent of the monthly pension is to be paid to the spouse or to the dependent child. If former president dies in office, the allowance equal to the president’s pension is to be paid to the spouse or dependent child. If there is more than one dependent child, the allowance will be paid to them after being divided into equal parts.

According to the law, the pension and the other payments must be paid to the ex-president from deserting his presidential post till his death. If the ex-president dies, it must be paid to the spouse of the ex-president, to the child until he or she reaches 18. In general, the payment of pension and grants and other provisions will be considered in the state budget. The pension and grants paid to the ex-presidents are free from tax.

The clauses of any law and rules on medical supply determined for civil service will also concern ex-president and his (her) family members.

The law considers to give 3 security staffs, one driver, one service car, the payment of representation expenses in amount of 20% of monthly salary of person, who is in the presidential post, and to give a diplomatic passport for life to ex-president and his (her) spouse.

Ex-president can not be brought to administrative or criminal responsibility for the acts made before his (her) election or during fulfilling its obligations. His (her) spouse will not be brought to the demonstrative and criminal responsibility for the acts made by ex-president during the period of fulfilling the obligations or previous periods. Ex-president can’t be brought to responsibility, detained, examined without the consent of the General Prosecutor except the detention on the scene of the crime.

According to the law, the archive consisting of copies of personal correspondence documents is kept in ex-president’s order.
